Who are we?

Our web site and all pages thereof, including the web site through which you accessed these Terms and Conditions (collectively the “Web Site” or “Site”, and each a “Web Site” or “Site”) are each operated by Easy Home Rentals (“Easy Home Rentals” or “we” or “We” or “us”). Unless stated otherwise, the terms, conditions and notices contained herein (collectively, the “Terms”) apply to all pages of the Web Site, including your use of and access to the applications, software, products, content and services made available on the Web Site, such as the proprietary Easy software, user interface software, and other software included in the Easy Home Rental platform (the “Services”) and, unless otherwise stated thereon, to any other Easy Home Rentals website that you access by or through any of the Site.

Easy Home Rentals reserves the right to alter, update, add to and/or revise these Terms from time to time and at any time. Any such alteration, update, addition or revision will be effective immediately upon its posting to any of the Site. We encourage you to periodically review these Terms, so you are aware of any revisions to which you are bound.

In addition, particular Easy Home Rentals features and activities offered on the Site may also be subject to additional terms (“Additional Terms”), all of which are incorporated herein by reference. If any of the Terms contained herein conflict with any Additional Terms presented in connection with any such other Easy Home Rentals features and activities, then the Additional Terms shall control to the extent of the conflict.

1. Use of the Site and/or Services

1. Your access to and use of the Site and/or Services is subject to all applicable laws and regulations which apply to the Site and/or Services, as well as these Terms. Your accessing of the Site and/or your use of the Site and/or any Services that we offer by or in connection with the Site constitutes acceptance of these Terms, without reservation, limitation or qualification. We reserve the right to suspend the use of the Site or Service generally or block your access to any part of the Site or Service if we suspect misuse.
2. You may not use the Site and/or Services if any of the following conditions apply to you: (i) you are not above the age of majority in the jurisdiction from which you are accessing this Site (“Your Jurisdiction”); or (ii) it is otherwise illegal in Your Jurisdiction for you to access, view and/or use the Site and/or Services. You must not use the Site or Services or cause or permit the Site or Services to be used if any of these conditions apply to you, including if any material on the Site, your use of this Site and/or Services, or products advertised on this Site, is contrary to the laws of Your Jurisdiction. If any of these conditions apply to you, please leave this Site immediately and cease using the Services. If you do not leave this Site or cease using the Services, then you will be deemed for all purposes to have represented that none of these conditions apply to you.
3. The information posted on this Site and through the Services is believed to be accurate when posted, but is not warranted or represented in any way to be so. Any use or reliance on such information is at your own risk. Your access and/or use of this Site and/or Services is strictly on an “as is” basis, and you must not assume that this Site and/or Services will be error-free or that it will operate without interruption or as intended. We reserve the right to suspend the use of the Site and/or Services generally, or block your access to any part of the Site and/or Services, if we suspect misuse.
4. We further reserve the right to disclose to the relevant authorities and in accordance with applicable law any information we hold concerning your identity and any evidence we have which relates directly or indirectly to misuse of this Site and/or Services.

2. Intellectual Property

1. All references in the Site to trade names, trademarks, logos, service marks, designs and other intellectual property (“Intellectual Property”) are references to the owner and/or licensee(s) of such Intellectual Property, and all rights in respect of all of such Intellectual Property are reserved. “®” refers to a registered trademark of the owner of the Intellectual Property in Your Jurisdiction; “™” refers to a trademark of the owner of the Intellectual Property in Your Jurisdiction; and “©” refers to a copyright of the owner of the Intellectual Property in Your Jurisdiction.
2. Unless otherwise noted or provided in these Terms or in the text on the Site, Easy Home Rentals owns all right, title and interest in and to the Intellectual Property. Nothing from the Site may be used by you except as provided in these Terms without the written permission of Easy Home Rentals, and you will not use the Intellectual Property for any unlawful or infringing purpose. You agree not to reproduce or distribute the Intellectual Property in any way, including electronically or via registration of any new trademarks, trade names, service marks, or Uniform Resource Locators (URLs), without prior express written permission from Easy Home Rentals. Easy Home Rentals neither warrants nor represents that your use of materials displayed on or downloaded from the Site will not infringe rights of third parties not owned by or affiliated with Easy Home Rentals.
3. Nothing contained on the Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed on the Site without the prior written permission of Easy Home Rentals or any third party that may own any such item displayed on the Site. Your use of any of the Intellectual Property displayed on the Site and any other content on the Site is strictly prohibited except only and to the limited extent expressly permitted in these Terms. Easy Home Rentals will aggressively enforce its intellectual property rights to the fullest extent of the law, should you breach any of these Terms.
4. Subject to your compliance with these Terms, we hereby grant you (whether a single individual or entity) a limited, revocable, worldwide, non-exclusive, non-transferable license to access and use the Web Site and Services, subject to the terms and conditions of these Terms including the restrictions set forth in section 4 below. Where the Services are made available as “software as a service” (SaaS), the License comprises the rights to access and use the Services, and the software included in the Services, solely for your internal use and business purposes where applicable in accordance with these Terms.
5. Except for the License granted in this Section 2, nothing in these Terms shall be construed as conferring any licenses or other rights under the intellectual property or other proprietary rights of us and our licensors, affiliates or any third party, in the Web Site or the Services. In addition, we reserve the right to disable the Web Site and/or Services, or elements of the Web Site and/or the Services, at our sole discretion.

3. Your Data

1. With respect to any data and other content that you post, upload, or communicate, or permit to be posted, uploaded, or communicated to the Site or through the Services (the “Data”), you hereby grant to us, our licensors, and our affiliates a perpetual, irrevocable, worldwide license to use, process, and reproduce any Data, without compensation, without any obligation to report on such use, processing, and reproduction, and without restriction.
2. Without limiting the generality of the foregoing, you acknowledge that we, our licensees, and our affiliates may, at our discretion, compile, aggregate, combine with other information, conduct data analytics, develop and manipulate the Data, and create derivative materials using the Data, without compensation and without restriction. As between us and you, you acknowledge that we will own all right, title, and interest in and to compiled and aggregated Data, provided that such compiled and aggregated Data does not identify you or contain any personally identifiable information of any individuals associated with you.

4. Your Conduct and Content

You will not use the Site or Services to:

1. upload, post, e-mail or otherwise transmit any material that contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Site and/or Services;
2. interfere with the servers or networks connected to the Site and/or Services or to violate any of the procedures, policies or regulations of networks connected to the Site and/or Services;
3. impersonate any other person while using the Site and/or Services;
4. conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Site and/or Services;
5. submit or otherwise publish through the Site and/or Services or on any social media or other forums accessible from it any material or content which is defamatory, offensive, pornographic, abusive or threatening or which describes any illegal activity or advertises any goods or services;
6. submit or otherwise publish through the Site and/or Services or on any social media or other forums accessible from it any material or content which infringes the intellectual property rights of a third party;
7. use the Site and/or Services for any unlawful purpose; or
8. resell, sublicense or export any software associated with the Site and/or Services.

Parts of the Easy Home Rentals platform and software enable you to provide, share, or communicate text, photos, information, feedback, and other content (“Content”). By providing Content, in whatever form and through whatever means, you grant Easy Home Rentals a non-exclusive, worldwide, royalty-free, perpetual, sub-licensable, and transferable license to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit, in any manner such Content to provide and/or use the Easy Home Rentals platform and software, in any media or platform, known or unknown to date, and in particular on the Internet and social networks. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Easy Home Rentals (including its affiliates) the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party.

You agree that Easy Home Rentals may make available services or automated tools to generate or translate Content. Easy Home Rentals does not guarantee the accuracy or quality of generated Content or translations, and Members are responsible for confirming the accuracy of generated Content and translations.

5. Account

1. Where applicable, you may be required to register for a user account (“Account”) on the Site or Services, in order to place orders or transactions with us. If you register an Account on the Site or Services, you will provide us certain information to create, verify, and access your Account. In connection with the creation and verification of your account, we may ask for information including your name, address, and identifying personal information, images of your likeness, and copies of government-issued photo identification, the collection, use, and disclosure of which will be governed by our Privacy Policy.
2. You agree to provide us with accurate, complete, and current information about yourself during Account registration and at all other times, including, without limitation, when you place an order, and you agree to update all information provided to us or requested by us if, and as soon as, such information changes and before you make any product purchase.
3. In addition to any other remedies available to us, we may in our sole discretion restrict or terminate your Account, or cancel or refuse orders for violations of, or abuse of, these Terms.
4. You agree to keep your Account log-in credentials confidential and to not authorize any third party to use your Account. You will not solicit, collect, or use the login credentials of other individuals. We prohibit the creation of, and you agree that you will not create, an Account for anyone other than yourself.
5. Your Account is personal to you. You may not use your Account to place orders or transactions with us on behalf of any other person, including any other person who is not eligible for an Account or who is not entitled to purchase products from us.
6. We will not be liable for any loss or damage that results from the unauthorized use of your Account, either with or without your knowledge. You are fully responsible for your failure to safeguard information or for permitting any other person to access or use your Account, and you agree that we may attribute all use of your Account to you. You agree to notify us immediately if you suspect any unauthorized use of your Account or any other breach of security.

6. Limitation of Liability and Indemnity

1. Your use of and browsing in the Site and/or Services are undertaken at your own risk. Neither Easy Home Rentals, nor any of its directors, officers, employees, or agencies, nor any other party involved in the creation, production, delivery or operation of the Site and/or Services is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of the Site and/or Services or any consequences flowing therefrom, including, without limitation, use of or browsing in the Site and/or Services or your downloading of any materials, data, text, images, video or audio from the Site and/or Services.
2. Without limiting the generality of section 6.1, everything on the Site and/or Services is provided to you without any warranty or representation of any kind, whether expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or any purpose, non-infringement or any other warranties which may be implied according to the laws of any jurisdiction including Your Jurisdiction, unless in Your Jurisdiction the exclusion of some or all of such expressed or implied warranties is not permitted or is restricted, in which case all such expressed or implied warranties are excluded to the fullest extent permitted by law in Your Jurisdiction. By using the Site and/or Services, you acknowledge that we are not realtors or a real estate company, and we do not offer real estate services or rent or lease any property. The Site and Services are made available solely for advertising the properties of others for rental and lease. We do not represent or warrant that any descriptions of properties made available by way of the Site and/or Services are accurate or complete, and such descriptions remain the sole responsibility of the host user who posted them.
3. You promise to indemnify and save and hold Easy Home Rentals, and its officers, directors, employees, agents and distributors, harmless from and against any and all claims, demands, liabilities, costs and expenses whatsoever, including without limitation reasonable legal fees and disbursements, resulting directly or indirectly from: your breach of any of your agreements, representations or warranties set out in these Terms; your access to or use of the Site and/or Services or any site to which the Site is or may be linked from time to time, or your use of, reliance on, or publication, communication or distribution of anything on or from the Site and/or Services or any site to which the Site and/or Services may be linked from time to time, including your use of or reliance on anything contained in any description of property available through the Services, which shall remain the sole responsibility of the host user who posted them; and/or your violation of any law or regulation.
4. Nothing in the Site and/or Services is intended as professional advice or recommendations (including financial, legal or other professional advice). We are not realtors or real estate advisors. It is your responsibility to obtain appropriate advice suitable to your particular circumstances from a qualified professional before acting or omitting to act based on any information obtained on or through the Site and/or Services.
5. The Site and the Services may not be completely secure from unauthorized access. You should not share confidential or sensitive information via the Site and/or the Services, and any personal information that you share and any subsequent use of such personal information is your responsibility and may be subject to our Privacy Policy.

7. Fees and Payment

1. Easy Home Rentals may charge fees (and applicable taxes) to hosts and users for the right to use the Easy Home Rentals platform or Services on the Easy Home Rentals platform. Any applicable fees are disclosed to users before making a booking. Except as otherwise provided on the Easy Home Rentals platform or Services on the Easy Home Rentals platform, service fees are non-refundable. Easy Home Rentals reserves the right to change the service fees at any time, and will provide notice of any fee changes. Fee changes will not affect bookings made prior to the effective date of the fee change.
2. You are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income, or other taxes. In certain jurisdictions, tax regulations may require that we withhold taxes from payouts to you. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided.
3. You authorize us, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide. This may include screening you, your representatives and beneficial owners against third-party databases or other sources, requesting reports from service providers, and reviewing government-issued identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws, and taking other steps to confirm ownership of your email address, Payment Information, and other personal information.
4. All payments related to the Services are processed through Easy Home Rentals’ payment processor, Stripe. By providing payment information which may include credit card information, you authorize Easy Home Rentals to provide your payment information to Stripe, its payment processor, and you authorize Easy Home Rentals and its payment processor to charge all fees in connection with your usage of the Site and/or Services, which may include fees for listing with Easy Home Rentals through one or more of the Site, or fees for a deposit or payment for a rental through one or more of the Site. Stripe and other third-party services are subject to different terms of service and privacy policies, and you should review them. We are not responsible or liable for the use of Stripe and other third-party services.
5. In some cases, we may take payment for rental or lease of a property on a one-time basis, for a specified rental term. In other cases, we may take payment for rental or lease of a property on a subscription or recurring basis. In such cases where we take payment for rental or lease of a property on a subscription or recurring basis, unless otherwise agreed between us, you authorize us, via our payment processor, to charge your credit card every thirty (30) days for the applicable fees corresponding to the rental. Rental rates are subject to change.

8. Cancellation, Disputes, and Refunds

1. We do not offer refunds for users who book properties through the Site and/or the Services. If you are unhappy with a property that was leased or rented through the Site and/or the Services, any request for a refund must be directed to the host user who posted the property for rent or lease. We are not responsible for processing any refunds.
2. Whatever the refund policy of other users, booking fees charged by us, and service fees that are charged by our payment processor, may not be refundable.
3. Any dispute between a renter user and a host user shall be resolved between the renter user and host user. We are not responsible for settling, adjudicating, or mediating disputes between renter users and host users, and make available no Services for any such settlement, adjudication, or mediation of disputes.
4. Our cancellation policies are subject to change. Our current cancellation policies are as follows, for Easy Home Rentals.

   Easy Home Rentals

   1. Unless the host user specifies otherwise, the host user (i.e., the landlord, realtor, property manager, lessor or other host user) is entitled to cancel and may cancel a renter’s subscription or the remaining term of the applicable rental or lease, at any time. Unless the host user specifies otherwise, the cancellation will become effective at the end of the then-current term that has been paid for by the renter.

Once payment is made for an applicable period, unless the host user specifies otherwise, there is no refund offered for any remaining period on the applicable rental or lease, upon cancellation.

9. Insurance

1. We do not offer cancellation insurance, dispute insurance, or other insurance. Insurance will be the host and renter’s responsibility.
2. We recommend that renters purchase general liability insurance, cancellation insurance, and/or insurance to protect themselves in the event of a dispute, however we do not specify any minimum insurance coverage and do not represent or warrant that host users or renters are insured or have any particular value of insurance coverage.

10. Confidentiality and Privacy Issues

1. Unless encrypted, information sent or received over the Internet is insecure and Easy Home Rentals cannot and does not make any representation, warranty or promise concerning the interception by third parties of your personal or other information. Easy Home Rentals will not be responsible for any damages you or any third party may suffer as a result of or in connection with the transmission of any information from or to Easy Home Rentals through the Site and/or Services.
2. Through your accessing or usage of the Site and/or Services, Easy Home Rentals is able to and may in fact gather certain information about you and your usage of the Site and/or Services. In so doing, Easy Home Rentals will comply with the Easy Home Rentals Privacy Policy available at www.EasyHomeRentals.com (“Privacy Policy”), which is incorporated herein by reference.

11. Linked Sites

1. Easy Home Rentals does not warrant the authenticity or reliability of the websites linked to the Easy Home Rentals Site and is not responsible for the contents of any linked website. The inclusion of a link on an Easy Home Rental Site does not constitute endorsement of the linked website by Easy Home Rentals. Use of any such linked website is at the user’s own risk.
2. The Sites may contain links to other sites on the Internet that are owned and operated by third parties (the “External Sites”). Easy Home Rentals has no control over these External Sites, all of which have separate privacy policies, data collection practices and terms and conditions independent of Easy Home Rentals. Easy Home Rentals has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices, the terms and conditions or the content of such External Sites. These links to External Sites are only for your convenience and therefore you access them at your own risk. Links do not imply that Easy Home Rentals sponsors, endorses, is affiliated with or associated with, or has been legally authorized to use any trademark, trade name, service mark, design, logo, symbol or other copyrighted materials displayed on or accessible through such External Sites.

12. Consent to Communications

By providing us with your contact information and using the Site and/or Services, you agree to receive communications via e-mail and/or social media from or on behalf of Easy Home Rentals at the email address or telephone number you provided. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

13. No Third-Party Rights

Unless expressly stated in these Terms to the contrary, nothing herein is intended to confer any rights or remedies on any persons other than you, Easy, and our successors and assigns. Nothing in these Terms is intended to relieve or discharge the obligation or liability of any third persons to you and Easy Home Rentals and our successors and assigns, nor shall any provision give any third parties any right of subrogation or action over against you, Easy Home Rentals, and our successors and assigns.

14. Our Contract

1. Unless expressly stated in these Terms to the contrary, nothing herein is intended to confer any rights or remedies on any persons other than you, us, and our successors and assigns. Nothing in these Terms is intended to relieve or discharge the obligation or liability of any third persons to you and us and our successors and assigns, nor shall any provision give any third parties any right of subrogation or action over against you, us, and our successors and assigns.
2. These Terms only deal with your access to and use of the Site and/or Services. Please note that we may not necessarily keep a copy of these Terms and Conditions. We advise you to print or save a copy of these Terms for your information in the future. If you would like these Terms and Conditions in another format (for example: audio, large print, braille) please contact us.
3. If any provision of the Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
4. You may not assign or otherwise transfer the Terms without our prior written consent, which may be withheld in its sole and absolute discretion. Any other purported assignment shall be void.
5. Both parties agree that these Terms are the complete and exclusive statement of the mutual understanding of the parties hereto, and supersedes and cancels all previous written and oral agreements, communications and other understandings between the parties hereto relating to the subject matter of these Terms, and that all waivers, amendments and modifications must be in a writing signed or otherwise agreed to by both parties, except as otherwise provided herein.
6. This use of the Easy Home Rentals Site and Services and any claims against Easy Home Rentals shall be governed by the laws of the Province of Alberta. You consent and submit to the exclusive jurisdiction of the courts located in the City of Edmonton, in the Province of Alberta, Canada, in respect of all disputes arising out of or relating to the use of Easy Home Rentals Web Site and/or Services and these Terms and Conditions.
